Terms and Conditions

This is a translation for your convenience. The German version at www.msk-scripts.de/de/terms is authoritative. German statutory references (§ = section, Art. = article) are kept unchanged.

§ 1 Scope

(1) These Terms apply between Moritz Kohm, trading as "MSK Scripts", c/o Impressumservice Dein-Impressum, Stettiner Str. 41, 35410 Hungen ("MSK Scripts", "we") and you for:

• the shop at www.msk-scripts.de (FiveM resources), insofar as MSK Scripts is the licensor – the seller is Tebex Limited (§ 2);
• the Ticket Bot transcript service including Hosted Bot Management (§§ 5–7);
• the Giveaway Bot (§ 8);
• the image gallery, MSK Paste and MSK Shortener (§ 9);
• the use of the website in all other respects.

For MSK Forms, the terms at forms.msk-scripts.de/terms apply.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB); an entrepreneur is anyone acting in the exercise of their trade, business or profession (§ 14 BGB).

(3) These Terms are available at www.msk-scripts.de/terms and can be saved and printed. The contract language is German; the English version is provided for information, and in the event of discrepancies the German version prevails.

§ 2 Shop: contracting party, payment, delivery

(1) Purchases in the shop are handled by Tebex Limited, 201 Haverstock Hill, London NW3 4QG, UK, as the seller and "Merchant of Record". The purchase contract, payment, invoice, VAT and the right of withdrawal for shop purchases are governed by the terms of Tebex (https://checkout.tebex.io/terms). As licensor, MSK Scripts grants you the rights of use under § 3.

(2) For delivery you sign in with your CFX.re account; the resource is provided in the CFX.re Keymaster under "Granted Assets" after payment (FiveM Asset Escrow). Packages with a Discord role require a Discord ID and membership of our Discord server. Use requires an active CFX.re account and a server with an internet connection; offline use is not possible.

(3) In the case of technical problems for which we are responsible, we provide support and assist with refunds through Tebex.

§ 3 Shop: rights of use

(1) With your purchase you receive a non-exclusive, non-transferable, unlimited right to use the resource on one (1) FiveM server at a time ("single server licence"). Subscriptions ("everything as a subscription") grant this right for all included resources for the duration of the subscription.

(2) The following are not permitted: use on several servers at the same time; resale, transfer, sublicensing or publication; circumvention of the asset escrow system; decompilation or reverse engineering, unless §§ 69d, 69e UrhG (German Copyright Act) mandatorily permit it; publication of the source version.

(3) The source version may be modified for your own server; modified versions are subject to the same restrictions.

(4) All rights, in particular copyright, remain with MSK Scripts. In the event of violations, MSK Scripts may terminate the licence and withdraw the resource in the Keymaster; claims for damages are reserved.

(5) Updates: We provide security and functional updates for purchased resources for as long as the resource is offered in the shop, but for at least 24 months from purchase (§ 327f BGB). We are not responsible for changes to the FiveM platform made by Cfx.re that are outside our control; we endeavour to adapt promptly.

(6) Towards consumers, the statutory warranty rights for digital products (§§ 327 ff. BGB) apply insofar as MSK Scripts is the contracting party; otherwise warranty claims are to be asserted against Tebex, and we will support you in doing so.

§ 4 Free software and open source

Resources provided free of charge (e.g. msk_core, msk_fuel), the Ticket Bot, the Giveaway Bot source code, MSK Paste and MSK Shortener are subject to the open source licences stated in the respective repository (as a rule AGPL-3.0 with an additional term under section 7(b): the reference to MSK Scripts remains visible). For free software we are only liable for fraudulently concealed defects (§§ 523, 524 BGB) and under § 12.

§ 5 Ticket Bot transcript service: service and tiers

(1) The service allows operators of the self-hosted MSK Ticket Bot to upload ticket transcripts to our servers and retrieve them via a link.

Optionally billed yearly: €49/year (Premium), €99/year (Hosted), €199/year (Business). The services are the same; the term is then twelve months (§ 6 (1)).

Prices are final prices; VAT is not shown pursuant to § 19 UStG.

(2) Branding waiver: For servers with an active Premium, Hosted or Business subscription we waive the additional term under § 4; the notice may be removed. The waiver ends with the subscription.

(3) Conclusion of contract: You select a tier in the dashboard, check the details and click "Subscribe with obligation to pay"; this constitutes an offer that we accept by activating the tier and sending a confirmation email (containing the contents of the contract and these Terms, § 312f BGB). You can correct input errors up until you click.

(4) Trial period: New customers receive a one-off 14 days free of charge without a payment method. Without a payment method on file, the subscription ends automatically and falls back to Basic; no charge is incurred. With a payment method on file, the trial period converts into a paid subscription on the billing period you selected (monthly or yearly) unless you cancel beforehand. We notify you by email three days before it expires.

§ 6 Subscriptions: term, cancellation, withdrawal

(1) Subscriptions run monthly and renew by one month at a time unless cancelled. Billing is handled by Stripe in advance at the start of each billing period.

(2) Cancellation is possible at any time with effect from the end of the current billing period: via the "Cancel contracts here" button in the site footer (§ 312k BGB, no login required), via "Manage subscription" in the dashboard (Stripe customer portal), or by email to info@msk-scripts.de. We confirm the cancellation by email without delay. After cancellation the tier falls back to Basic; existing transcripts remain available until their individual expiry, custom domains and bot hosting are deactivated (§ 7 (5)).

(3) We may cancel the subscription with four weeks notice to the end of a billing period; in the event of serious violations (§ 10) without notice.

(4) Right of withdrawal: Consumers have a 14-day right of withdrawal. The withdrawal instructions with the model form and the electronic withdrawal function "Withdraw from contract" can be found at www.msk-scripts.de/terms/widerruf. If the service begins during the withdrawal period at your request, on withdrawal you owe the proportionate value of the service provided up to that point; during the free trial period nothing is owed.

(5) We announce price changes at least six weeks in advance in text form; they take effect from the next billing period after that deadline. You may cancel until then.

§ 7 Ticket Bot: API key, content, domain, hosting

(1) API key: The key is tied to one Discord server and must be kept secret. On re-verification the previous key becomes invalid. In the event of misuse we may block keys.

(2) Responsibility for content: Transcripts and attachments are created by your bot; you are responsible for their content. For the storage you conclude the data processing agreement with us at www.msk-scripts.de/terms/avv (Art. 28 GDPR) and ensure that your users are informed about the storage at MSK Scripts. Illegal content, infringements of third-party rights and malicious code are not permitted.

(3) Public URLs: Transcripts are accessible via random, unlinked URLs to anyone who knows the URL. You decide who you pass links on to. After the retention period expires, transcripts are deleted; beyond that there is no claim to availability.

(4) Custom domain: You must be the owner of the domain and set the DNS A record. We set up TLS via Let's Encrypt. We may remove misconfigured or unlawfully used domains.

(5) Hosted Bot Management: We operate your bot on our servers (PM2) under a subdomain of msk-scripts.de or your own domain and provide you with a management panel. You transmit the bot token, client ID and client secret; these are stored in an .env file on our server which we can access for support and maintenance. You are responsible for registering the redirect URL with Discord, for granting permissions in your bot dashboard, for compliance with the Discord terms of service, and for the content your bot processes. After termination the bot and address are shut down, the installation is archived for 14 days (you can restore it yourself) and then deleted; we hand over configuration files on request.

§ 8 Giveaway Bot

(1) The Giveaway Bot is free of charge, usable without an account and provided without any guarantee of availability. We may change or discontinue it at any time, or remove it from individual servers in the event of misuse.

(2) As a server administrator you are solely responsible for the lawfulness of your giveaways (prizes, terms of participation, competition and consumer law), for delivering the prizes, and for informing your members about the use of the bot. MSK Scripts is not the organiser.

(3) Use for unlawful lotteries or gambling, spam, and illegal content or prizes is not permitted.

§ 9 Image gallery, Paste, Shortener

(1) When submitting images you warrant that you hold all necessary rights, and you grant us the non-exclusive right to make the image publicly available in the gallery and in our channels for the presentation of our products; you may request removal at any time. We review submissions before publication.

(2) Our own images (gallery category "Brand"). Logos, banners and brand graphics by MSK Scripts are original works and protected by copyright. You may use them unchanged wherever they refer to MSK Scripts or our products, for example in your server's Discord, in forum posts or in guides; no separate permission is required for that. It is not permitted to pass them off as your own work, to use them as your own or your server's logo, to edit them or to use them detached from any reference to MSK Scripts, nor is any use permitted that suggests a cooperation with us or an endorsement by us that does not exist. Any use in connection with pornographic, violence-glorifying, extremist, discriminatory or otherwise unlawful content is strictly prohibited; this covers the images themselves as much as the sites and services they appear on. We may revoke the permission in sentence 2 at any time with effect for the future.

(3) The remaining gallery categories show game content by Rockstar Games and Take-Two Interactive. MSK Scripts claims no rights to it and cannot grant any; we provide the images for non-commercial use in the FiveM community. If you hold rights to an image and want it removed, contact info@msk-scripts.de.

(4) MSK Paste and MSK Shortener are free tools without any guarantee of availability. Illegal content, phishing targets, malicious code and the circumvention of blocks are not permitted. Short links to reported targets are deactivated.

§ 10 Content moderation and reporting procedure (Art. 14, 16, 17 DSA)

(1) We do not review user-provided content (transcripts, images, pastes, short links, giveaway pages) comprehensively, but on a case-by-case basis. We do not use automated filters to assess content. Uploaded images are technically re-encoded and file attachments are checked against permitted file types in order to remove malicious code; this does not involve any assessment of the content.

(2) Anyone can report illegal content by email to info@msk-scripts.de (URL, reasons, name, email, statement of accuracy). We confirm receipt, decide promptly, diligently and proportionately, and inform the reporting party.

(3) Possible measures: a warning, removal of the content, blocking of functions or API keys, termination of the contract. If measures are taken against you, you receive a statement of reasons (measure, facts, rule violated, means of redress). You can lodge a complaint free of charge by email within six months; recourse to the courts remains open.

(4) If we suspect criminal offences against the life or safety of persons, we inform the law enforcement authorities (Art. 18 DSA).

§ 11 Availability and changes

(1) We aim for high availability but do not guarantee any uptime. If the transcript service is unreachable during an upload, the bot sends the transcript as a file via Discord DM instead.

(2) We only change paid services for good cause, at no additional cost and with prior notice (§ 327r BGB). In the event of a not insignificant impairment we give six weeks notice; you may then cancel free of charge within 30 days.

§ 12 Liability

(1) We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and for guarantees we have given.

(2) In cases of simple negligence we are only liable for the breach of material contractual obligations, limited to the typical, foreseeable damage. Otherwise liability is excluded, in particular for changes to the FiveM platform, temporary unavailability, data loss after the retention period has expired, transcript links passed on by you, and DNS misconfiguration.

§ 13 Changes to these Terms

We may change these Terms for good cause (change in the law, case law, change to the services), provided this does not unreasonably disadvantage you. For subscriptions we inform you at least 30 days in advance in text form, with a note about your right to object and the consequences; if you object, we may cancel with effect from the end of the billing period. For free services, changes take effect on publication; significant changes to the moderation rules are announced on Discord (Art. 14 (2) DSA).

§ 14 Dispute resolution, applicable law, place of jurisdiction

(1) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.

(2) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with their habitual residence in another EU state, the mandatory protective provisions of their state of residence remain unaffected (Art. 6 (2) Rome I).

(3) Towards merchants, legal persons under public law and special funds under public law, the place of jurisdiction is Mannheim. For consumers, the statutory places of jurisdiction apply.

(4) Should individual provisions be invalid, the remainder of the contract remains effective; the statutory provisions then apply.
